TLDR:
Fresh Start is the name for IRS collection rules from 2011 and 2012, plus payment plan updates made in 2025.
There is no Fresh Start application and no deadline. Semper Tax Relief reviews your IRS transcripts, gets your filings current, identifies which IRS option may fit, and can represent you with the IRS from start to finish.
Fresh Start Tax Relief Services We Provide
When people search for Fresh Start help, they usually need one of these services. Each one links to its own page with full details.
IRS Payment Plans
We set up IRS payment plans, including the Simple Payment Plan for balances of $50,000 or less, and negotiate larger plans when the IRS requires financial review.
Offer in Compromise
We calculate your reasonable collection potential before you apply, then prepare and submit the offer if your numbers support it.
Tax Lien Withdrawal and Removal
We request lien withdrawal when you qualify, and pursue discharge or subordination when you need to sell or refinance.
Currently Not Collectible Status
If you can't afford any payment right now, we document the hardship and ask the IRS to pause collection.
Partial Pay Installment Agreements
If your verified ability to pay won't cover the full balance before the collection statute expires, a partial pay plan may be an option.
Unfiled Tax Returns
Almost every Fresh Start option requires your returns to be filed first. We prepare and file the missing years.
Business and Payroll Tax Debt
We set up business payment plans and handle payroll tax balances, including trust fund issues.

The 2025 IRS Payment Plan Change Most Fresh Start Ads Leave Out
In 2025, the IRS replaced the 72 month streamlined installment agreement for individuals with the Simple Payment Plan. If you owe $50,000 or less, you may now have up to 120 months to pay, or until the collection statute expiration date if sooner, and direct debit is no longer required to avoid a lien filing if the plan is set up before a lien is filed. In December 2025, Simple Payment Plans were extended to businesses.
A longer term can mean a lower monthly payment, but interest and penalties keep growing. We help you choose a payment you can keep without paying more than you need to.

How Our Fresh Start Process Works
Step 1, Free Case Review
We talk through your notices, balance and goals. No fees are discussed until we understand your situation.
Step 2, Review Your IRS Transcripts
With your authorization, we pull your IRS account transcripts to confirm what you owe, which years are open and how much time is left on each collection statute.
Step 3, Get Your Filings Current
If returns are missing, we prepare and file them so the IRS will consider your request.
Step 4, Recommend Your Option, With the Numbers
We compare the options that may fit, including whether you may qualify for IRS Penalty Forgiveness, and show you the math behind each one. If an offer is unlikely to be accepted, we'll tell you before you spend money on it.
Step 5, Represent You With the IRS
With a signed Form 2848, we communicate with the IRS for you, submit your request and follow it through to a decision.

The Fresh Start Name Isn't What It Seems
"Fresh Start" sounds like a government program that wipes the slate clean. It isn't. The IRS used the phrase to describe a set of collection policy changes in 2011 and 2012. It never created a Fresh Start application, enrollment, approval letter or deadline. Over time, tax relief marketing turned that phrase into something that sounds far more official, and far more generous, than what the IRS actually announced.
Common Fresh Start Claims vs What the IRS Actually Says
Claim: "Enroll in the IRS Fresh Start program."
Reality: There is nothing to enroll in. You request a specific IRS option, such as a payment plan or an offer in compromise, and the IRS decides based on your finances and filing history.
Claim: "New program. Limited time. Act before it ends."
Reality: The rules date to 2011 and 2012. There is no Fresh Start deadline. The only deadlines that matter are the ones printed on your IRS notices.
Claim: "Settle your tax debt for pennies on the dollar."
Reality: In fiscal year 2025, the IRS accepted 5,464 offers in compromise out of 38,797 received, roughly 1 in 7. An offer works only when your assets and future income show you cannot pay the full balance.
Claim: "You've been pre-qualified for Fresh Start."
Reality: No one can tell whether you qualify without reviewing your income, expenses, assets and IRS records. The IRS offers its own free Offer in Compromise Pre-Qualifier tool.
Claim: "Guaranteed settlement."
Reality: No one can guarantee what the IRS will accept. Not us, not anyone.
Claim: Ads designed to look like official government notices or programs.
Reality: Private tax relief companies are not the IRS. If an ad or mailer uses official sounding language, check who actually sent it before you call.
What the IRS Has Said About These Claims
The IRS has warned taxpayers about "offer in compromise mills" that make "false claims of guaranteed settlements for 'pennies-on-the-dollar'" and "usually charge excessive fees for a service taxpayers could have obtained themselves directly from the IRS."
Then IRS Commissioner Danny Werfel put it plainly: "Many OIC mills charge steep fees, give false assurances and can take advantage of taxpayers with empty promises."
And in 2025, the IRS noted that "eligible taxpayers pay the OIC mill to get the same deal they could have received on their own."
The IRS has also listed OIC mills on its annual Dirty Dozen list of tax scams.

The rules are real IRS policy, but Fresh Start is not a single program you enroll in. What can be misleading is how some ads describe it, as new, limited time or a near guarantee of settling for less.
The IRS has warned about companies that promise guaranteed "pennies on the dollar" settlements.
